The Non-Exclusive License
On our marketplace, purchasing is simplified thanks to our unique license: all the designs present in our catalog are sold under a non-exclusive use license, whether for personal use or for commercial production without limit of support , territory and for a maximum duration of 10 years. A design can thus be purchased and used by several buyers.
The purchased design can be used for:

- create and resell digital content incorporating the design (in this case, the distribution of the design can only be done in low definition resolution (72 dpi maximum) and in JPG format.
Licensed buyers have permission to adapt the colors and scale of the pattern where technically possible.
Duplication, resale or sublicensing of all or part of the design is prohibited. The Design cannot be purchased for resale as is. Likewise, the use of all or parts of the elements constituting the design as a company logo or as a trademark is prohibited.

Which file should you choose between JPEG and source file (vector or Photoshop layers)?
By default, you will receive a high-resolution JPEG file (300 DPI), but you can also choose the vector source file (.AI or .EPS) or Photoshop layers format (.PSD) if it is available for sale.
The advantage of choosing the source file is that you can then modify the colors and scale of the design (especially to enlarge it while maintaining its quality, applicable to the Illustrator .AI format). Depending on the initial size of the design, it can be very useful to be able to enlarge it to suit any medium or project. You can then simply save the source file in the desired format (e.g., JPG format for use with an online printer, or .TIFF/.AI/.PSD format for a local printer who prefers to use the source file for printing).
In summary, a JPG may be sufficient for online printing, but a .PSD or .AI source file allows for more freedom (modification of colors, scale, and flexibility for the printer).

What is copyright?
Copyright consists of a set of rights held by a creator or their beneficiaries over original intellectual works for which the creator can prove the prior existence of their creation. It comes into being on the date the work is created.
The creator holds economic rights, which are their rights to exploit the work, and moral rights, which are attached to their person. The creator may transfer their economic rights to a third party to exploit the work, namely the right of representation, the right of reproduction, the right of adaptation, and the resale right. The creator retains their moral rights (the right to authorship of your work, the right of disclosure, the right of repentance or withdrawal, and the right to respect for the work).
On French Design, the creator authorizes the buyer to exploit their right of reproduction under certain conditions detailed in French Design's non-exclusive license.
What is an exclusive license?
An exclusive license gives the licensee exclusive rights of use.
Advantages:
- For the buyer: The buyer is the only one who can exploit the transferred right in relation to their competitors for a given application, sector of activity, and territory.
- For the designer: An exclusive license allows the designer to sell their design at a high price, to which royalties on each sale may be added.
Disadvantages:
- For the buyer: The acquisition cost for the buyer is higher (from an average of €500 for an all-over pattern in 2023, according to our survey).
- For the designer: The designer can no longer resell the pattern in the sectors of activity and territories used by the customer.
What is a non-exclusive license?
A license is non-exclusive when the right of use can be granted to several customers. In other words, a design sold under a non-exclusive license can be purchased and used by several buyers, for the sectors of activity and territories specified in the license.
Advantages:
- For the buyer: The acquisition cost is lower. On French Design, designs are sold at affordable prices starting at €40 excluding tax (price varies depending on the size of the pattern).
- For the designer: The non-exclusive license allows you to sell to a multitude of customers, reaching a wider market and thus generating more potential revenue. This formula on French Design also offers designers greater flexibility while reducing their marketing costs (no upfront costs to find new customers). Finally, French Design provides a solution that encourages the reuse of unsold designs (on average, 25% of the designs created each season are sold as one-offs for exclusive use. Unfortunately, the remaining 75% are mostly lost forever - according to our survey)
Disadvantages:
- For the buyer: The buyer is not the only one to hold the transferred rights and may find the same design at one of their competitors.
- For the designer: Once their design has been purchased under a non-exclusive license, they can no longer resell that design under an exclusive license.
The difference between a partial and full license
A license, whether exclusive or non-exclusive, can be partial or full.
A partial license for a design includes limitations on territory, duration, and/or sector of activity.
A full license for a design does not include any particular limitations.
For example, a partial exclusive license is a license that gives the purchaser the exclusive right to use the design (they are the only ones who can purchase and use it) for a given territory (e.g., for sales in Europe only) or for a given sector of activity (e.g., for application of the design in the bed linen sector only).
Conversely, a total non-exclusive license is a license that gives the buyer a non-exclusive right to use the design (they are not the only one who can purchase and use it) without any restrictions on territory and/or sector of activity (e.g., the buyer may use the design, in accordance with the rights granted, in the bed linen sector, in the women's fashion sector, and also in the stationery sector).
